I-Percut processes your personal data in compliance with applicable laws and regulations on privacy and personal data protection, including French Law No. 78-17 of January 6, 1978 on Information Technology, Data Files and Civil Liberties, and Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation – GDPR), which came into effect on May 25, 2018.

Interpretation and Definitions

Interpretation

Words with an initial capital letter have meanings defined under the following conditions. The definitions shall have the same meaning whether they appear in singular or plural form.

Definitions

For the purposes of this Privacy Policy:

« Application » means the software program provided by I-Percut that you download onto any electronic device.

« Account » means a unique account created for you to access our Products and Services or parts thereof.

« Device » means any device that can access the Products and Services, such as a computer, mobile phone, or digital tablet.

« Usage Data » means data collected automatically, either generated by the use of the Products and Services or from the infrastructure itself (e.g., duration of a page visit).

« Personal Data » means any information that relates to an identified or identifiable natural person.

« Service Provider » means any natural or legal person who processes data on behalf of I-Percut. It refers to third-party companies or individuals employed by I-Percut to facilitate the Products and Services, provide them on behalf of I-Percut, or assist in analyzing how they are used.

« Products and Services » refers to our connected products, software, applications (mobile and web), software used to operate the Products and Services, and cloud services.

« Third-Party Social Media Service »  means any website or social network site through which a user may log in or create an account to use the Products and Services.

« Affiliate » means an entity that controls, is controlled by, or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for election of directors or other managing authority.

« You » means the individual accessing or using the Products and Services, or the company or other legal entity on behalf of which such individual is accessing or using the Products and Services, as applicable.

Collection and Use of Your Personal Data

Personal Data

While using our Products and Services, we may ask you to provide certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to:

• Email address
• First and last name
• Phone number

Usage Data

Usage Data is collected automatically when using the Products and Services. It may include information such as your device’s Internet Protocol (IP) address, browser type, browser version, pages visited, time and date of visit, time spent on pages, unique device identifiers, and other diagnostic data.

When you access the Products and Services via a mobile device, we may collect certain information automatically, including but not limited to the type of mobile device used, unique mobile device ID, IP address, mobile operating system, type of mobile internet browser, unique device identifiers, and other diagnostic data. We may also collect information sent by your browser whenever you visit our Products and Services or access them via a mobile device.

Information from Third-Party Social Media Services

I-Percut allows you to create an account and log in to use the Products and Services through the following Third-Party Social Media Services:

• Apple
• Facebook
• Google

If you choose to register or grant us access via a Third-Party Social Media Service, we may collect Personal Data already associated with your account, such as your name, email address, activities, contact list, or other Personal Data associated with that account.

By choosing to provide such information during registration or otherwise, you grant I-Percut permission to use, share, and store it in accordance with this Privacy Policy.

Information Collected While Using Our Applications

While using our Applications, and with your prior authorization, we may collect:

• Location information
• Contact list information
• Images and other data from your device’s camera and photo library
 
We use this information to provide, improve, and personalize our Products and Services. The data may be uploaded to I-Percut’s servers and/or to a service provider’s server, or it may be stored locally on your device.

You can enable or disable access to this information at any time via your device settings.

Use of Your Personal Data

I-Percut may use Personal Data for the following purposes:

• To provide and maintain our Products and Services, including monitoring their usage.

• To manage your Account, including registration and access to features available to registered users.

• To contact you, via email, phone calls, SMS, or equivalent forms of electronic communication, including push notifications regarding updates or informative communications related to contracted features, products, or services, including security updates.

• To provide you with news, special offers, and general information about other goods, services, and events we offer that are similar to those you have already purchased or inquired about, unless you have opted out of receiving such information.

• To respond to and manage your requests.

• To fulfill a contract, including the development, compliance, and execution of purchase agreements or other contracts entered into via the Products and Services.

• For business transfers, including evaluating or conducting mergers, divestitures, restructurings, reorganizations, dissolutions, or other sales or transfers of our assets, whether as part of ongoing operations or bankruptcy, liquidation, or similar proceedings, in which Personal Data held by us forms part of the transferred assets.

• For other purposes, such as data analysis, usage trend identification, effectiveness measurement of our Products and Services and promotional campaigns, and to evaluate and improve our Products and Services, marketing, and user experience.
 

I-Percut may share your Personal Data in the following situations:

• With Service Providers: to monitor and analyze usage of our service, or to contact you.

• For business transfers: during or in connection with mergers, sales of assets, financing, or acquisitions of our business by another company.

• With Affiliates: in which case we will require those affiliates to honor this Privacy Policy. Affiliates include our parent company and any subsidiaries, joint venture partners, or other companies under common control.

• With business partners: to offer you certain products, services, or promotions.

• With other users: when you share personal information or interact publicly with other users, such information may be visible to all users and may be publicly distributed outside. If you interact with other users or register via a Third-Party Social Media Service, your contacts on that service may see your name, profile, photos, and activity description. Likewise, other users may view your activity descriptions, communicate with you, and view your profile.

• With your consent: we may disclose your Personal Data for any other purpose with your consent.

Retention of Your Personal Data

I-Percut will retain your Personal Data only for as long as necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

I-Percut will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or improve the functionality of our Products and Services, or when we are legally obligated to retain this data for longer periods.

To enable your use of our Products and Services, your data is retained until you request its deletion. If you wish to delete your data and account, you may contact us by email at vie-privee@i-percut.com.

Upon request for deletion, all your personal data will be permanently erased within 30 days.

If your data and account have been deleted and you wish to use our Products and Services again, you will need to create a new account.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at I-Percut’s operating offices and in any other locations where the parties involved in the processing are located. This means that such information may be transferred to — and maintained on — computers located outside your state, province, country, or other governmental jurisdiction where data protection laws may differ from those in your jurisdiction.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

I-Percut will take all reasonably necessary steps to ensure that your data is treated securely and in accordance with this Privacy Policy, and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place, including the security of your data and other personal information.

Disclosure of Your Personal Data

Business Transactions

If I-Percut is involved in a merger, acquisition, or asset sale, your Personal Data may be transferred. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law Enforcement

Under certain circumstances, I-Percut may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g., a court or government agency).

I-Percut may disclose your Personal Data in the good faith belief that such action is necessary to:

The security of your Personal Data is important to us, but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

Children’s Privacy

Our service is not intended for individuals under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us.

If we become aware that we have collected Personal Data from anyone under the age of 13 without verification of parental consent, we will take steps to remove that information from our servers. If we rely on consent as a legal basis for processing your information and your country requires parental consent, we may require your parent’s consent before collecting and using that information.

Our Products and Services may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

Facebook Data Deletion Instructions

In accordance with Meta’s platform policies, we are required to provide a URL with instructions for data deletion.

If you wish to remove the I-Percut mobile app’s access to your Facebook account, please follow these steps:

1- Click on your profile picture in the top right corner of Facebook.
2 - Select "Settings & Privacy", then "Settings".
3 - Click on "Apps and Websites" in the left menu.
4 - Locate the app or game you want to remove, then click "Remove" next to the app or game name.
5 - You may select the following option: Allow Facebook to notify [app or game] that your login has been removed. You might be offered an alternative login method.
6 - Click "Remove" again to confirm.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time.

We will notify you of any changes by posting the new Privacy Policy on this page. We will inform you via email and/or a prominent notice on our service prior to the change becoming effective and update the “Last updated” date at the top of this Privacy Policy.
